Resolution of the 46th District Democrats
For the proper conduct and count of 2004 Presidential Election ballots,
in accordance with US Constitutional requirements.
Whereas the Constitution of the United States specifies a procedure for
the election of the President and Vice President, based on State
Elections followed by an Electoral College (Section 2, Amts. XII, XX).
Whereas the election shall be based on a total certified count of all
citizens eligible to vote, exercising that right; and that this did not
occur.
Whereas based upon an ad hoc incomplete sampling and projection of
results by news media, et al; the 2004 Presidential Election process was
aborted and conceded prematurely, without due process for all eligible
voters.
Whereas prior to concession of defeat, and prior to due process of the
vote count, the tally was incomplete, including:
- Legal absentee ballots in transit to the Auditor
- Unprocessed provisional ballots
- Incomplete ballot processing and counting
- Incomplete ballot counting due to equipment malfunction
- Incomplete vote verification and certification
Whereas prior to concession of defeat, and prior to due process of the
vote count, numerous election irregularities were noted at the polls,
including:
- Reported voter harassment causing disenfranchisement
- Reported equipment malfunction causing uncounted votes
- Reported equipment malfunction causing false vote totals
- Voting systems preventing adequate audit of vote count
Whereas the Constitutional process provides adequate time for proper
vote tally, verification and certification between the Election (Nov
2nd) and the beginning of the Electoral College (Dec 7th).
Whereas without regard to party affiliation, or the final election
result; all citizens should protect and defend the sanctity of the
democratic process and the contribution of every vote, to the highest
degree possible.
Therefore be it resolved that anyone affiliated with any election
campaign in a particular race will be required to remove themselves from
said vote counting to avoid any and all conflicts of interest.
Therefore be it resolved that the Democratic Party shall take an
immediate, active, and aggressive roll in the investigation,
publication, and prosecution of any and all election irregularities,
with a full disclosure of available resultant information prior to the
beginning of the Electoral College.
Therefore be it resolved that the Democratic Party shall assist with
prosecution of any persons responsible for intentionally causing
election irregularities or disenfranchisement, to the maximum extent
provided by law.
Therefore be it resolved that the Democratic Party shall insist that
certified vote tallies of all eligible voters (with estimates of
disenfranchised voters) be published prior to the beginning of the
Electoral College.
Therefore be it resolved that the Democratic Party shall insist that
future elections abide by the provisions of the US Constitution, thus
providing adequate time for due processing of each citizen's vote, to
the maximum extent reasonably possible.
Therefore be it resolved that the Democratic Party shall strongly
support and participate in ongoing efforts to reform the process by
which votes are tallied, verified, and certified. This shall include,
but not be limited to, the prohibition of Direct Recording Electronic
voting machines that do not provide a voter-verifiable legal paper
ballot.
